Welcome to donovantattoos.com (the "Website"), the online portfolio and booking platform for tattoo artist Donovan Lankford ("I", "me", "my", "the Artist").

Please read these Terms and Conditions ("Terms") carefully before using the Website or booking an appointment. By accessing or using the Website, or by booking an appointment, you ("you", "the Client") agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Website or book my services.

 

1. Eligibility and Age Requirement

 

You must be at least 18 years of age to get a tattoo. You will be required to present a valid, government-issued photo ID (such as a driver's license, passport, or state ID card) at the beginning of your appointment. No exceptions will be made to this policy.

 

2. Booking and Deposits

 

  • Booking Process: To request an appointment, you must fill out the booking form on the Website. Submitting a form does not guarantee an appointment. I will review your request and contact you via email to discuss your idea, pricing, and scheduling.

  • Deposits: A non-refundable deposit is required to secure your appointment date and time. This deposit covers the time spent on design preparation and holds your place in my schedule. The deposit amount will be communicated to you during the booking process.

  • Payment: The deposit will be deducted from the final price of your tattoo. The remaining balance is due in full at the end of your appointment.

 

3. Cancellation, Rescheduling, and Late Policy

 

  • Cancellation: If you cancel your appointment for any reason, your deposit will be forfeited.

  • Rescheduling: If you need to reschedule, you must provide at least 72 hours' notice prior to your scheduled appointment. If sufficient notice is given, your deposit can be transferred to a new appointment date one (1) time. If you provide less than 72 hours' notice, or if you need to reschedule a second time, your deposit will be forfeited and a new deposit will be required to book another appointment.

  • Late Arrival: Please arrive on time for your appointment. If you are more than 20 minutes late without prior communication, your appointment may be canceled and your deposit will be forfeited.

 

4. Tattoo Design and Artwork

 

  • Artistic Freedom: I will create a custom design based on your ideas and reference materials. The final design will be shown to you on the day of your appointment. Minor adjustments can be made at that time.

  • Major Design Changes: Significant changes to the design idea or placement after the initial consultation may require a new deposit and rescheduling of the appointment.

  • Intellectual Property: All artwork and designs created by me, Donovan Lankford, including flash designs and custom drawings, are my intellectual property. The copyright for the artwork remains with me. You are purchasing the service of having the art tattooed on your skin, not the rights to the artwork itself. The artwork may not be reproduced or used for any other purpose without my express written permission.

 

5. Client Responsibilities

 

  • Health Conditions: It is your responsibility to inform me of any medical conditions, allergies, or skin conditions that might affect the tattoo process or healing.

  • Sobriety: You must not be under the influence of alcohol or drugs when you come to your appointment. If you are, I will refuse service, and your deposit will be forfeited.

  • Aftercare: You will be provided with detailed aftercare instructions following your tattoo session. You are responsible for following these instructions carefully. I am not liable for any infection, allergic reaction, or other issues resulting from poor aftercare.

 

6. Right to Refuse Service

 

I reserve the right to refuse service to anyone for any reason, including but not limited to:

  • The requested design is offensive, discriminatory, or promotes hate.

  • The client is behaving in a disrespectful or inappropriate manner.

  • The client is under the influence of drugs or alcohol.

  • The desired tattoo placement is not suitable or poses a significant health risk.

 

7. Website Use

 

  • Permitted Use: The content on this Website (images, text, artwork) is for your personal, non-commercial use only. You may use it to view my portfolio and request an appointment.

  • Prohibited Use: You may not copy, reproduce, distribute, or create derivative works from any content on this Website without my prior written consent.

 

8. Disclaimers and Limitation of Liability

 

  • Inherent Risks: You acknowledge that getting a tattoo is a permanent body modification and carries inherent risks, including but not limited to pain, infection, scarring, and allergic reactions. You agree to assume these risks by proceeding with the tattoo.

  • No Guarantees: While I am committed to providing the highest quality work, tattoos can change and fade over time due to sun exposure, skin type, and lifestyle. The final appearance and healing of your tattoo can vary, and no guarantees can be made.

  • Website Content: The information on this Website is provided "as is" without any warranties, express or implied.

  • Limitation of Liability: To the fullest extent permitted by law, Donovan Lankford shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any permanent or temporary side effects from the tattoo procedure.

 

9. Governing Law

 

These Terms shall be governed and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

 

10. Changes to Terms

 

I reserve the right, at my sole discretion, to modify or replace these Terms at any time. The most current version will be posted on the Website. By continuing to access my Website or services after those revisions become effective, you agree to be bound by the revised terms.
